Terms and conditions
These terms explain how AppGast works, what you can expect from the platform and the conditions that apply when you use it. By registering or using the service, you accept the current terms described in this document.
1. Purpose and acceptance of the terms
AppGast is a technology platform built for restaurants, bars and other food and beverage businesses. These terms govern access to and use of the service.
By registering or using the service you accept these conditions. If you do not agree with any of them, you should not register or use the platform.
Using the service assumes you have the authority required to act on behalf of the business you represent.
In these terms, references to the "user" or the "business" include anyone who registers, uses or accesses the service, on their own behalf or on behalf of the business.
These terms apply to the use of the website and the platform. Specific conditions informed during subscription processes or inside the platform itself are part of these terms.
2. Description of the service
AppGast is a technology provider: it does not prepare or sell the business's products to the end consumer. It provides tools that help your business build its digital presence and manage parts of its day-to-day operation. Among its current capabilities, and without being exhaustive, the platform allows you to:
- Publish a digital menu and a QR code menu for your customers.
- Manage a commerce-owned online ordering channel, supporting pickup and delivery orders.
- Customize the public menu, create promotions and run content in multiple languages.
- Integrate with certain external services and complementary tools depending on each account's configuration.
3. Registration and user account
To use the service you can create an account. You should provide accurate information and keep the relevant details of your account up to date.
You are responsible for keeping your login credentials secure and for the activity carried out with your account. If you detect unauthorized use, please let us know as soon as possible.
The specific features available depend on the contracted plan and the applied configuration, and may be added or adjusted over time.
If incorrect or incomplete information is provided, we may not be able to provide the service in full.
We recommend that you do not share your credentials with third parties and that you notify us immediately of any suspected unauthorized access.
You can update your account information directly in the platform or by contacting our team.
The account and the business associated with it must correspond to accurate information. If contact or billing details change, keep the information up to date to ensure proper service administration.
4. User content and information
The business is responsible for the content published on AppGast: business name, products, prices, images, descriptions, promotions and any other data related to its operation.
When publishing content you must have the rights you need over what you upload. AppGast may use that content technically, as needed to provide the service, without the content ceasing to be yours.
To provide its features, AppGast may process information generated while the service is in use.
Published content must comply with applicable rules and must not mislead customers about the business, its products or its prices.
If we detect content that breaches these terms or applicable rules, we may reasonably request its correction or removal.
5. Plans, pricing and trial period
Paid plans are billed with monthly periodicity. The available plans, current prices and applicable commercial information are those published on the Pricing page.
Some ordering plans differ according to the included monthly order volume.
AppGast offers a 14-day trial period so you can get to know and evaluate the service. Once the trial period ends, to keep using the features subject to subscription, you should contract the corresponding plan.
For accounts in the Argentina market, subscriptions are currently managed in Argentine pesos through MercadoPago, and public prices are shown with VAT included, according to the current information on the Pricing page.
For markets outside Argentina, subscriptions are currently managed in US dollars through PayPal.
If in a given month you exceed the order volume included in your plan, that single overage does not trigger an automatic additional charge or force an immediate plan change. If the limit is exceeded again in the following month, you should adjust your plan to the corresponding volume.
Specific cancellation conditions, when applicable, will be those informed during the subscription or account management process.
In addition to subscriptions, professional services or custom developments may have a scope and price independent from the subscription.
The applicable plans, prices and commercial conditions are those published on the site at the time of subscription.
During the trial period you can evaluate the features available under the corresponding trial plan.
Conditions informed at the time of subscribing to a plan apply from the start of the corresponding subscription.
Choosing a plan or activating additional features will be reflected in the account configuration and in the information of the corresponding subscription.
6. Third-party services and integrations
AppGast may interoperate with external services such as payment providers, printing services, fiscal services, logistics or other tools.
These services belong to third parties: they have their own terms and conditions, may apply their own fees or commissions, and may modify or discontinue their services at any time.
The availability of each integration may vary by country and account configuration. AppGast does not control the operation of external platforms.
Some integrations may require a separate account at the external service or additional configuration by the business.
Before enabling an integration, the business should review the conditions of the external service, which apply independently of these terms.
7. Permitted use of AppGast
Use of the platform must be in good faith, consistent with the purpose of the service and within the limits of the corresponding account. By way of example, you are not allowed to:
- Do not use the platform for illegal or fraudulent activities.
- Do not publish content that infringes third-party rights.
- Do not interfere with the security or operation of the service.
- Do not access systems, accounts or information of others without authorization.
- Do not distribute malicious code or attempt to compromise the infrastructure.
- Do not use content for which you do not have the necessary rights.
8. Intellectual property
AppGast, its software, visual identity, brand, interfaces and own components are protected by the corresponding rights.
By using the service you receive the right to use it while you have valid access. Your business's own content does not become AppGast's property.
No rights over the platform are transferred beyond those expressly provided in these terms.
9. Availability and liability
AppGast works to keep the platform available and operational. However, scheduled maintenance, technical incidents or causes beyond our reasonable control may occur, such as internet outages or failures of external providers.
We may carry out service maintenance tasks, seeking to minimize the impact on normal use.
AppGast provides a technology tool: your business is responsible for its operation, its products, prices and content, and for the relationship with its customers. Each business defines and publishes its own commercial conditions towards its customers; AppGast does not take part in that relationship.
AppGast does not guarantee that external services operate uninterruptedly. Nothing in these terms excludes liabilities that cannot be lawfully excluded.
The platform may be temporarily unavailable for these reasons, without this implying non-compliance with these terms.
If an external service becomes unavailable, the features that depended on it may be limited until the provider restores it.
For questions about the service or its availability, you can review the information published on the site or write to us through the indicated contact channels.
Access to the service may require a stable internet connection and compatible devices; the experience depends, in part, on the equipment and connectivity of the business itself and its customers.
10. Service changes and suspension
As the platform evolves, AppGast may improve, modify, add or remove features, seeking not to affect the normal use of the service. The scope of new capabilities depends on the evolution of the platform and the needs of the operation.
On a reasonable basis, the service may be suspended for non-compliance with these terms, unlawful use, security risks or non-payment.
Suspensions, when they occur, will be communicated on a reasonable basis, unless circumstances or applicable law prevent it.
These actions are taken on a reasonable basis and aim to preserve the security and integrity of the platform and its users.
11. Changes to these terms and contact
These terms may be updated as the service evolves, for commercial, technical or legal reasons. The current version will be the one published on this site, and relevant changes will be communicated when appropriate.
